good evening a san jose police officer who intended to scare a teen has unnerved his department. now they are considering new rules on how cops in ter act with people they know. it is all because of a fake arrest caught on a cell phone camera. lisa amin gulezian is live with the story. lisa? >> dap, the fake arrest is causing a lot of things to happen. an internal investigation is going on. the d.a. is looking into all this, and now the police department is creating new code of conduct procedures.

>> the boy accused having sex with the man's stepdaughter took this video on august 30th. he gave it to the san jose mercury news. we showed it to the independent police auditor. judge kordell couldn't comment directly because she is looking into all the allegations. she did pinpoint two policies listed in the duty manual that should be scrutinized. >> when an officer is on duty or off duty, officers will avoid becoming officially involved in quarrels or disputes occurring in their own neighborhoods. >> the other is an article dealing with the code of conduct involving personal feelings. the teenager's yrent pa insist -- parents insist the officer was out of line.

>> do you know what that means? no. not a good thing. the person is the cop's daughter. >> the officer's attorney paints a different picture, one of a concerned father who is given permission by the boy's parents to use scare straight tactics. >> at no time do you hear the parents of the young man objecting, getting upset, crying. so the video is absolutely exculpatory from the cop's perspective. >> and the attorney points to this moment when the father talks to his son while cuffed. >> use your head. >> his department in the meantime is reviewing the duty manual which does not make specific mention of this type of behavior. >> we determined that there should be probably a very specific section that addresses this or several versions into creating one.

>> sergeant lopez says the officer may have violated more than just those two policies. he is currently on administrative leave. lisa amin gulezian, abc7 news. >> thanks very much. a judge cleared the way for california's first execution in nearly five years. that means that pending any last-minute appeals albert brown will be put to death one minute after midnight next wednesday morning. he would be the first death row inmate executed in the newly thatew, lethal injection procedure. and he will have a choice how his life will end. lilian kim is here to explain. lilian? >> death row inmate albert brown has a decision to make, to be executed with a three-drug combination as used in the past or with a single drug, a heavy dose of sodium pentathal. brown has until tomorrow to make his choice.

>> executions will resume next week. albert brown is scheduled to receive a lethal injection one minute past midnight. the victims' rights group, citizens against homicide says it is about time. >> truth in sentencing needs to happen. i think moving forward so these families can have some sort of closure is a positive thing. >> it is california's first execution in nearly25 years. a judge gave the go ahead now that prison officials complied with his order. they built a roomier chamber and has revised how they are trained. >> they are coming in with evidence there is about to be an unconstitutional execution. he finds the evidence is not there, and there is no reason he can find legally to bar this execution. >> albert brown was convicted of raping and murdering 15-year-old susan jordan of riverside county 30 years ago. brown grabbed her, tied a

shoelace around her neck and pulled her into an orange grove. then later this night brown called jordan's mother telling her "you will never see your daughter again." jordan's family is counting on next week's execution. they say their 30-year wait is long enough. >> we are a christian family. attorneys with the aclu are helping with the legal challenges. >> there is much more litigation to come. all the more reason why we need to stop these proceedings. the stakes here really are too high and too many unanswered questions for this to continue. >> on monday, attorneys will ask a marin county judge for a temporary restraining order suspending executions. they also will be taking their case to the 9th circuit court of appeals. dan? >> lilian kim reporting. now more information on this subject, there are690 people

on death row that are men at san quentin. 18 women are awaiting their execution at the central california women's facility. clean up is in full swiping in the heart of the san -- full swing in the heart of the san bruno disaster zone. they have signed a liability waiver that includes a guarantee they will not have any out of pocket expenses. pg&e says they will pick up the estimated $60,000 cost per house. the clean up is being done due to strict environmental regulations. and from clearing debris to saying goodbye. nearly a thousand people attended a memorial service for three more victims of the san bruno disaster. three generations of one family. abc7's amy hollyfield has the story. >> almost a thousand people gathered to remember three members of the bullis family.

levon and her 50-year-old son greg and his 17-year-old son, will. >> they loved one another, they loved their community. they loved their church community. they play together and laugh together. they are a great family. they touched a lot of lives. >> so many the church and neighborhood ran out of parking spaces. so buses and ferry people to outdoor high schools. they were provided to handle the large crowd. >> he was hysterical. >> friends remembered greg's sense of humor saying he was always playing practical jokes on people. his son, will, was a senior at mills high school and a youth deacon at church. he was remembered for his gentle presence. and 85-year-old levon was described as a warm and patient woman described as a deacon at church. friends say surviving members of the family at times feel over -- overwell med by grief. >> they have no way to go

own recovery process, a gesture i'm sure they appreciated. governor shart sharts is calling on -- governor schwarzenegger is calling on a law to make it illegal for them to work in the state's healthcare program which provides care to the elderly and disabled in california. and while some claim a person's past does not affect their ability to provide care, the governor believes they pose a grave threat to vulnerable people. >> it is the equivalent of saying come and take care of my grandmother. >> it is providing good care for an individual like myself. >> state documents show there are 210 violent felons working in the program or applied for jobs in the program. governor schwarzenegger vetoed a bill that would require ski resorts to report accidents. there was a statement saying many ski resorts are on u.s.

an abc7 news exclusive. two court employees are under arrest accused of fixing tickets in exchange for cash. vic lee reports from fremont. >> hernandez was arrested in late august. deputies say he got caught up in a sting by alameda county sheriff's office in the

fremont courthouse. a woman they are not identifying came up to the traffic window to pay a ticket. a source says it was a large fine. deputies say hernandez offered to fix the ticket in return for cash. instead, she reported the bribe offer. sources tell us they were $100 bills. the woman then handed the money over to hernandez as deputies watched. this is sergeant jd nelson. >> that person did go forward and do that, had their record taken care of at basically a third less than what it would have cost. >> reporter: earlier last week, felix chavez was arrested after court officials launched an investigation to see who else may have been involved. >> after we arrested mr. hernandez we did an audit and found discrepancies. >> the alameda court

administrators denied our request for an interview. they said according to judicial cannons of et thuks and other restrictions, they were unable to comment on pending cases and related issues. appropriate administrative actions have been taken. both the court and the sheriff's office say they are investigating. >> the investigation on these two people is on going, and to see how far back it goes and how widespread it is. >> now, hernandez is charged with accepting a bribe, embezzlement and grand theft. as you just heard sergeant nelson say, the big question now is just how widespread were these bribes, and are they occurring in other courthouses? that is the focus of the investigation. vic lee, abc7 news. >> horrifying crime in florida. a bank was robbed there today by one of its own tellers humaned into a human

bomb. police say it began early this morning when three men burst into the teller's home and held him hostage. at about 8:00 a.m., they strapped a bomb to his chest, drove him to the bank and ordered him to rob it or be blown up. >> once he was able to secure the money with the assistance of the branch manager, he gave it to the two individuals who were waiting in the parking lot. he was ordered back to the bank. the individuals left in a red mustang. >> now, this is the teller with police after the heist. he has been cleared and released apparently. tonight the drug enforcement agency is hoping you can help solve a serious problem. the dea says many prescription drugs end up being abused by friends or family or sometimes they are stolen. so tomorrow you can drop off your unused prescription medication at police and sheriffs offices all-around the bay area. we have a list of the part pating agencies on our website. just click on "see it on tv." check your medicine cabinet.
